To verify your chances and loyalty points and present service offers available, Customers or Users can download the Magic Salon mobile application, available on Google Play, App Store, and Huawei AppGallery. To log in, the Customer or User must enter a unique identification code linked to their customer account. This code can be obtained via SMS to the personal phone number or, if necessary, from Magic Smart Group SRL locations and our partners.
You will receive notifications based on a completely voluntary consent that you can withdraw at any time by specifying via SMS to the phone number: 0786.723.486 that you no longer wish to receive alerts in the mobile application.

Based on these, MAGIC SMART GRUP SRL can better direct ads to interested users, personalize the webpage content with what truly interests you, and what you are searching for or what larger groups of users are interested in general. 3.6. To schedule an appointment, our salon colleagues will ask for your name and phone number. Based on this information, your appointment will be scheduled, and we will be able to contact you to confirm your presence.

4. Withdrawal of consent and cancellation of receiving communications or messages from MAGIC SMART GRUP SRL
4.1. Company communications. Users and customers of MAGIC SMART GRUP SRL can unsubscribe at any time from receiving communications:

5. Who has access to personal data?
5.1. Personal data is processed by MAGIC SMART GRUP SRL and its staff. After that, Magic Smart Grup SRL requests a new consent.
6.2. Data obtained for marketing purposes through cookies are processed by Magic Smart Grup for the duration of your consent for the use of cookies, as long as you allow the storage of cookies in your browser or until you express disapproval regarding the processing of personal data for this purpose.
6.3. Further processing of personal data, in addition to these deadlines, is carried out by MAGIC SMART GRUP SRL only if it is necessary to fulfill the obligations arising from the MAGIC SMART GRUP SRL regulation.

7. What rights do you have?
7.1. Regarding the processing of your personal data, you can contact MAGIC SMART GRUP SRL and request:

  • Information about your personal data that have been processed by MAGIC SMART GRUP regarding the purpose and nature of the processing of personal data, including information about potential recipients of personal data, outside MAGIC SMART GRUP SRL. General information about the processing of personal data is mentioned in this regulation.
  • Access to the data you provided to MAGIC SMART GRUP SRL, either during registration or when making an appointment. If you exercise this right, MAGIC SMART GRUP SRL will confirm whether and which personal data is being processed, and, if applicable, they will be made available to you, along with information about their processing.
  • The correction of personal data if they are inaccurate or incomplete.

8.1. MAGIC SMART GRUP SRL is responsible for the security of your data. The handling of personal data is fully compliant with the applicable legislation, including the General Data Protection Regulation (GDPR). MAGIC SMART GRUP values technical and organizational security when processing personal data.
8.2. All electronically stored personal data is stored in databases and systems accessible only to those who need to directly dispose of such personal data for the purposes specified in these rules and only to the extent necessary.
Access to this personal data is protected by a password and a firewall. The security of personal data is regularly tested by MAGIC SMART GRUP SRL and continuously improving its protection.

The campaign addresses only the individuals mentioned in Article 2.
A Tip represents a service, a service package, or a product at a reduced price.
Tips can be purchased through the Saloanele Magic mobile application, available on Google Play, App Store, and Huawei AppGallery.

The tips can be found in the main menu of the application, in the top button named "Tips," where numerous services, service packages, products, or packages with significant discounts are available.

Each Tip contains the following details: the service/service package/product, the salon name, and the validity period in which the tip is available.

Tips are purchased as follows: the beneficiary must select the "Buy" button from the desired Tip, fill in their card details, and complete the transaction.

The company SC Magic Smart Grup SRL stores the following personal data of the client: name, surname, phone number, date of birth, and email address. All this information is stored only in the client's personal account, and the company uses it exclusively with the client's consent and desire to purchase the Tips. This information is not used in any other way.

The company does not directly store any information regarding its clients' cards. Any form of payment is processed by NETOPIA, a dedicated online payment processing platform, and for any transaction made by customers, they are provided with a token.

Tips come in various types:

1. Product Tip:

If the client purchases a Tip with a product, they must pick up the product from the salon where it was assigned within a maximum of 7 days (the pickup location is available in the Tip details). The product is not sent by courier; it must be picked up in person.
f the product is not as described or for any other valid reason, it can be returned, and the equivalent value will be refunded in loyalty points to the client's account.

Service or Service Package Tip:

Tips with services or service packages are only valid at the assigned location. A validity period is set, and appointments will be made according to availability during that period.

The details of the tips cannot be modified, and their equivalent value cannot be refunded. Therefore, individuals who purchase them and, for any reason, do not show up for the appointment, will not receive a refund of the purchased Tip, nor can the Tips be rescheduled.

Article 5: Duration

The validity period of products/services/service packages falling under the category of Tips is mentioned in the details of each Tip.
The "Tip" offer campaign takes place for an unlimited period starting from May 14, 2019. The Organizer can decide to end the campaign at any time.

Article 6. Validity Conditions

To benefit from Tips, the beneficiary must meet the following conditions simultaneously:

a) The participant must meet the conditions in Article 2

b) If the beneficiary is a client of the Organizer, they must register in the application using the unique identification code, which they can obtain via SMS on their personal phone number or, if necessary, from the Magic Smart Grup SRL locations. It can also be obtained in the online environment: the chat in the application/ the chat on the website/ Facebook/ Instagram/ e-mail, etc.

Article 8 - Other Clauses

The Organizer reserves the right to modify this Regulation during the existence of TIPSwithout prior notification. The modified version will be brought to customers' attention by posting it on the website www.saloanelemagic.ro.

Article 4. CAMPAIGN

The campaign addresses only the individuals mentioned in Article 2.

During the campaign period, participants can register by following these steps:

  • • First and foremost, the Participant needs to install the mobile application "Magic Salons," available on Google Play, App Store, and Huawei AppGallery, and log in with their unique identification code. The authentication code is obtained through the Mobile Application. When the application is opened for the first time, the authentication will appear as a mandatory step.

The Participant needs to enter their phone number in the special box and, if found in the database, will receive a message with the authentication code. If they do not have an account, they can create one themselves by filling in the specific fields: name, surname, year of birth, and email address.

  • • The Participant must purchase at least one beauty service.
  • • Throughout the campaign, the Participant can earn more chances to win, either by purchasing beauty services or by purchasing products from the Magic Store.

The value of the chances received will depend on the category of each client - Butterfly, Silver, Gold, Diamond, or VIP. Thus, after paying for services and/or products at Magic locations, clients will receive the percentage corresponding to their category in the form of Magic Coins: Butterfly - 3%, Silver - 4%, Gold - 5%, Diamond - 6%, VIP - 7%. The percentage is automatically calculated based on the total amount of each transaction made at the salon, following the scanning of the QR code from the application. Each participant must present their individualized QR code at the salon's reception for scanning when paying for the services provided and/or the products they wish to purchase.

 

The value of the chances for the Magic America raffle will be directly proportional to the number of Magic Coins accumulated during the campaign period. The total number of Magic Coins can be found in the "My Account" section within the mobile application.

Registration for the contest will begin on January 3, 2023, until December 26, 2023 (inclusive).

On December 26 (at 00:00), the accumulation of chances will stop. The draw will take place on December 27, 2023, using the random.org randomization application.

 

Article 5. DESCRIPTION OF THE PRIZE AND WINNER SELECTION

The winner will be awarded a 6-day trip to New York, United States of America, for them and one other person of their choice.

The prize will include: round-trip flight from Bucharest to New York, meal and shopping card, 5 nights of accommodation in a hotel/house, mini-tours to the most important tourist attractions for the two beneficiaries of the prize.

In case the winner of Prize 1 does not obtain a visa, they can offer the prize either to a relative or to a dear friend (who, in turn, can select one friend to accompany them).

In this contest, no cash equivalent of the prizes will be awarded, and they cannot be exchanged.

The winner will be announced on December 27, by phone, on their designated phone number, and will be invited to celebrate the event. The entire process will be filmed: drawing of the winner, contacting them, and a short interview.

By accepting the prize, the winner agrees to have their name and image made public and used by the Organizer for advertising purposes, and the winner cannot claim any financial compensation from the Organizer for their creation and dissemination. If the Organizer finds that the person designated as the winner did not fulfill and/or comply with any of the conditions stipulated in this Official Regulation, the Organizer reserves the right to suspend or withdraw the rights and benefits that belong to the winner at any time, without the Organizer owing any compensation or payment to the respective winner. All rights arising from the promotion of the winner, including copyright, belong to the Organizer.
The Organizer will not provide any compensation in cash or other benefits to potential winners who do not fully meet the requirements of the Official Contest Regulation.

 

Article 6. PROCESSING AND PROTECTION OF PERSONAL DATA
By this Official Regulation, the Organizer and the advertising agencies involved in the organization of the Campaign undertake to comply with the provisions of:
• REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, hereinafter "GDPR");
Government Ordinance no. 99/2000 on the marketing of products and services on the market, as subsequently amended by Law no. 650/2002;
• Law no. 227/2015 on the Fiscal Code, with subsequent amendments and completions;
• The Romanian Civil Code, as well as all other applicable legal acts for the implementation of this campaign.
6.2 By enrolling in the Campaign, the Participants agree to all the provisions of the Regulation and undertake to respect them as such, fully understanding all their effects. As a result, if they win, the participants accept that, for the Organizer to fulfill the obligations imposed by art. 42, para. (2) from Government Ordinance no. 99/2000, their names and the prize won will be made public under the conditions mentioned above in this Regulation.
6.3. Registration in the Campaign, its development and effects involve the collection and processing of personal data. The personal data collected are: 
(i) for Participants: phone number; and
(ii) for winners: name, surname, signature, no. phone number, e-mail address, postal address, bank account, CNP from CI, photo.
6.4. The personal data operator (hereinafter referred to as the "Operator") is the Campaign Organizer, Magic Smart Grup S.R.L.
6.5. The purpose of collecting and processing personal data mentioned in art. 8.3 and 11.2 above represent: the registration in the Campaign, the running of the Campaign, the validation of the winner, the awarding of the prize, the awarding of the prize, the benefit of the won prize, the resolution of any complaints related to the running of the Campaign, formulated according to the provisions of these Regulations, as well as the fulfillment by the Organizer and Powers of attorney for the obligations stipulated by the legislation in force.
6.6. The legal basis for the collection and processing of personal data mentioned in art. 8.3 and 11.2 above constitutes the promotional campaign addressed by the Organizer to the general public, accepted by the participants through voluntary registration, and the legal basis is represented by art. 6 para. (1), letters a) and 11.7. Below are briefly described the rights that the GDPR confers on the Participants and the winner, as data subjects (the persons concerned):
A. Right of access to data
(1) Any Data Subject has the right to obtain from the Operator confirmation of the fact that the data concerning him are or are not being processed by him. Obtaining the confirmation is based on a written, dated and signed request, addressed to the Operator, sent to his address mentioned in Section 1 of the Regulation. 
(2) The Data Subject has access to the following information:
(a) the purposes of the processing;
(b) the categories of personal data concerned;
(c) recipients or categories of recipients to whom the personal data have been or will be disclosed, especially recipients from third countries or international organizations;
(d) where possible, the period for which the personal data is expected to be stored or, if this is not possible, the criteria used to establish this period;
(h) the existence of an automated decision-making process including the creation of profiles, mentioned in Article 22 paragraphs (1) and (4) of the GDPR, as well as, at least in the respective cases, pertinent information regarding the logic used and regarding the importance and the expected consequences of such processing for the data subject.
 (3) The operator provides free of charge a copy of the personal data that are the subject of processing. For any other copies requested by the Data Subject, the operator may charge a reasonable fee, based on administrative costs. If the Data Subject submits the request in electronic format and unless the Data Subject requests a different format, the information is provided in a currently used electronic format.
B. The right to rectification: refers to the correction, without undue delay, by the Operator of inaccurate personal data concerning the Data Subject. The Data Subjects have the right to complete or correct incomplete personal data, including by means of an additional declaration.
C. The right to data deletion (“the right to be forgotten”): Data Subjects have the right to request the Operator to delete personal data, without undue delay, if one of the following reasons applies: 
(i) personal data are no longer necessary to fulfill the purposes for which they were collected or processed; 
(ii) The Data Subject withdraws his consent and there is no other legal basis for the processing; 
(iii) The Data Subject opposes the processing and there are no legitimate reasons to prevail; 
(iv) Personal data has been processed illegally; 
(v) Personal data must be deleted to comply with a legal obligation;
D. The right to restrict processing can be exercised in the following cases:
(i) The Data Subject contests the accuracy of the data, for a period that allows the Operator to verify the correctness of the data; 
(ii) The processing is illegal, and the Data Subject opposes the deletion of personal data, requesting the restriction instead; 
(iii) The operator no longer needs the personal data for the purpose of processing, but the person requests them for establishing, exercising or defending a right in court; 
(iv) The Data Subject objected to the processing for the period of time in which it is checked whether the legitimate rights of the Operator prevail over those of the respective person.  
In the above cases, the respective data will be marked and can be processed by the Operator and/or his Powers of Attorney only for certain purposes.
F. The right to data portability: If during the course of the campaign and its effects the Organizer changes, the Data Subject has the right to receive the personal data concerning him and which he transmitted to the Organizer initially in a way structured, currently used and which can be read automatically and has the right to request the direct transmission of this data to the new organizer, without obstacles from the initial Organizer. 
G. The automated individual decision-making process, including the creation of profiles: the Data Subject has the right not to be the subject of a decision based exclusively on automatic processing, including the creation of profiles, which produces legal effects that concern or affect him in a similar way in a significant measure. The previously mentioned do not apply if the automatic processing is necessary for the conclusion or execution of a contract with the Organizer, if the Organizer has an authorization in this regard and if the person concerned has given his explicit consent. 
H. The right to object: The right to object, on grounds related to the Data Subject's particular situation at any time, to the processing of his/her personal data. In the case of exercising the objection to the processing, the personal data of the Data Subject who formulates the objection will no longer be processed. Exercising this right is free of charge. This right can be invalidated in particular if the processing of personal data is necessary for the formalities related to the fulfillment of legal or contractual obligations by the Operator and/or its Authorized Representative.
I. The right to file a complaint: The right to file a complaint with the National Authority for the Supervision of the Processing of Personal Data in relation to aspects related to the processing of personal data by the Operator and/or its Authorized Representative.
6.7. All the rights listed above are exercised by sending a written, dated and signed request to the Organizer's headquarters, mentioned in the preamble, or to the e-mail address marketing@saloanelemagic.ro.


Art. 7 Duration

Registration period: 03.01.2023 – 26.12.2023 (inclusive).

Art. 8 OTHER CLAUSES

The organizer reserves the right to modify these Regulations during the existence of the program of the "Magic America Raffle" campaign, please include the exact name of the contest, which appears on the application, without prior notification. Article 1. Organizer

Article 2. Participants

In campaign “Sweet 18” anyone 18 years old can register - with a maximum of one month before and after the birthday anniversary.

Art 4. Mode of development

The campaign is addressed to people who meet the conditions of Art. 2 and is valid within the locations provided in Art. 3.
The participants benefit from: dyed, bleached (if necessary), washed, dried, styled and cut, with Keune products, at the price of 99 lei, within the limit of 3 tubes of paint and 10 cups of bleaching powder, procedure called here is the Magic Tip 18/Sweet 18 Offer.

In order to benefit from the offer, it is necessary for the Participant to have the Magic Salons application installed on their phone. Details about the offer can be found in the Offers section, under the banner called "Sweet 18" Details. In the same column, the phone number can be entered in the marked box, in order to request a phone call from a Magic Salon representative. Later, during the phone call, the Participant will be provided with all the requested information and will be directed to purchase the offer for the salon where they wish to benefit from the services. The purchase can be made from the category "Ponturi" from the application, after the desired salon is selected. Thus, the "Magic 18" in the amount of 99 lei can be paid online, with the card, following all the necessary steps in the application.

After the purchase, the customer will be contacted by a Magic representative to establish the details of the appointment. If the client does not show up for the scheduled appointment, the service fee cannot be returned. Also, Pontul Magic 18 cannot be rescheduled either, as is also mentioned in its details in the application.

The Sweet 18 offer can only be scheduled on Mondays and Tuesdays, from 9:00 a.m., depending on the availability of colleagues from the participating salons. When coming to the salon for an appointment, it is necessary for the clients to present their ID to the colleagues at the reception of the salon, as proof of the fact that they are 18 years old during the previously mentioned period. Also, clients who benefit from this offer implicitly give their consent to have before&after photos taken by the salon staff.
This offer cannot be combined with other active promotions of the organizer and cannot be paid with loyalty points from the participant's customer account.

 

Article 5: Duration

The campaign starts on 29.06.2020 and has an indefinite period of validity.

Article 6 - Other Clauses

The organizer reserves the right to modify these Regulations during its existence, without prior notification.   • Article 1. Organizer

  • Art 2. Definitions and Terms

These terms and conditions apply to all users of the Magic Salons Mobile Application Saloanele Magic, as well as to anyone benefiting from Magic Store services Magic Oriunde. 

Any persons Magic Oriunde residing in Romania who has downloaded the Saloanele Magic application and wishes to place an online order can benefit from Magic Store services.

The eCommerce Magic Store service beneficiary is responsible for reading and understanding the Terms and Conditions.

Continued use of this service implies agreement and acceptance of these terms. The general terms and conditions set forth below apply to all sales of goods by Magic Smart Grup SRL through the Magic Store project and its partners and may be modified at any time by Magic Smart Grup SRL without prior notice.

Client Buyer - a natural and/or legal person benefiting from Magic Store eCommerce services, an online platform user. 

Magic Store Service Provider/Seller - the holder and administrator of the Saloanele Magic Application

and owner of Magic Store. Delivery Address/Location - The Magic Store concept covers the entire territory of Romania. Magic Oriunde, qualified professional to provide his service, after case, the beauty services ordered by the client.

Location and Concept Magic Oriunde includes as a geographical area all of Bucharest and the neighboring areas, but no further than an area of ​​20 km away from Kilometer 0 of Bucharest (Sf. Gheorghe cel Nou Church). 

The right to intellectual property all intangible rights, such as copyright and related rights, database rights, design rights, model rights, patents, registered trademarks, and domain name registrations for any of the above.

  • Art 3. Accessing the Platform and Using Magic Store Services

Magic Store services can only be used in accordance with the rules in the Terms and Conditions.

By implementing and making available the Saloanele Magic Mobile Application to Customers, the Provider creates a secure virtual environment in accordance with all legal and data security regulations, in order to ensure the connection between the client and the representative. 

By accessing and registering on the Platform, the Client certifies that: they are at least 18 years old, have full legal capacity, and there are no other legal impediments to engaging in legal relationships with the Magic Store provider, respectively, with the representatives of Magic Store. 

The purchase of services by the client is done as follows: the client accesses the Magic Salons application, logs in with the relevant client account or creates a new account using the application and accesses the heading "Scheduling". from the main page of the application.

At the beginning of the schedule configurator, the customer can select the option "Magic Oriunde". Afterwards, he configures his desired services online, fills in the address where he wants to benefit from them, chooses the day and the preferred time interval and sends the appointment request. Magic Store service provider will receive the client's request and will contact him by phone in order to confirm all the details of the appointment and the services to be provided.

By accessing and using the Magic Salons mobile application, respectively the Magic Store service, the customer agrees to receive calls and sms from the Magic Smart Grup SRL company, on the mobile phone, a necessary step to facilitate the completion of the order. During the telephone conversation, the exact time and what type of services the client wants will be determined. In the case of certain services, the current photo and/or a photo with the desired look can be requested, in order to obtain all the details that the Magic Store representative needs to perform the requested service.

The price of each individual service can be found in the mobile application, in the online configurator of appointment requests, in the Magic Anywhere section. When configuring the desired services, the lack of accuracy of the answers provided in the configurator can lead to an inappropriate price estimate.

After validating all the data, the client receives a secure payment link via SMS, and he will have to pay online the value of the configured services, through the payment processor. Online payment by card is the only payment option available. The "Saloanele Magic" application uses Netopia Payment as a payment processor.

SC Magic Smart Grup SRL does not store any information about its customers' cards and any other payment security details. The use of the Magic Oriunde Services represents the customer's acceptance of all the provisions of these Terms and Conditions, as well as the acceptance of the Privacy Policy. The Terms and Conditions, together with the Privacy Policy are hereinafter referred to as the Contract and governs the relationships between supplier, representative and client.

By expressing agreement on these Terms and Conditions, the customer:

a) expressly agrees to comply with all clauses in this contract, as well as any other applicable specific conditions, referred to in this contract;

b) expressly consents to the collection, storage and processing of personal data, as described in this contract and in the privacy policy;

The conclusion of any legal relationship between the client, supplier and representative is conditioned by the prior verification, at the date and time agreed upon with the client, of the location where the client will benefit from Magic Oriunde services. The verification will take place through a method established by mutual agreement between the supplier and the client. Only after validating the location, the customer can benefit from Magic Anywhere services. The customer must go through the location verification procedure, whenever it changes.

If the client cancels the appointment, he will be charged a cancellation fee, as follows:

- if the Magic Oriunde representative goes to the indicated address and is not answered, the customer receives back 25% of the value of the ordered services;

- if the client cancels the appointment less than 24 hours before the scheduled time of the service, he receives back 50% of the value of the ordered services;

- if the customer cancels more than 24 hours before the scheduled time of the service, he receives back 75% of the value of the ordered services;

The cancellation fee will be withheld from the value of the ordered and paid services, and the customer expresses his agreement in this regard, through this document.

Art 4. Provision of Magic Oriunde services

The provision of beautification services that are the subject of these conditions is carried out by Magic Oriunde representatives, by traveling to the location provided by the client, according to the schedule made by him through the mobile application. 

Through the Magic Oriunde platform, we aim to ensure the provision of services at the same quality standard that we also provide in the Magic Salons, meeting the time and service needs of clients. The services are provided by qualified representatives, who know and respect the quality of the services they provide. Failure to comply with the quality level corresponding to the service provided to the client will attract the exclusive responsibility of the representative, in the event of prejudice to the client.  

Defects of the equipment used in order to provide the services cannot represent a reason for attracting the responsibility of the supplier, and the impossibility to provide the ordered service, as a result of the non-functioning of the equipment, will lead to the possibility for the client to reschedule the provision of the services. 

The customer accepts a possible delay in the provision of any service compared to the time established by scheduling, as a result of weather and/or traffic conditions, by no more than 30 minutes before or after the established time. The representative has the obligation to notify the client in advance in case of delay.

The realization of Magic Oriunde services is based on professional products intended for these activities, the range of products being the same range that is used in Magic Professional beauty salons. The realization of Magic Oirunde services is done in sterile conditions and of maximum hygiene, all the instruments used being sterilized before each individual operation.

The customer will communicate to the Magic Oriunde representative any state of fact, medical condition, including but not limited to to limit ourselves to allergies, or natural surroundings to alter the result of the services rendered.

The customer assumes And he agrees that the result of the services provided may differ from person to person to another, depending on its anatomical features and the reaction of the body area that was intervened upon by providing the requested service.

The representative of Magic Oriunde was trained and informed regarding the legal norms imposed by the legislation in force, being obliged to use the protective measures appropriately throughout the stay. Throughout the direct interaction between the representative and the client, the latter must be personally present at the location, from the moment the representative arrives at the location and until the completion of all services, as a guarantee of the physical safety of the representative, as well as the client. Placing the order represents the client's agreement for the representative's entry into the location. The client, personally, will be the one who ensures access to the representative's location.

The client and the representative will maintain a climate of communication according to the services provided and an appropriate behavioral conduct.

The client will refrain from any illegal behavior, verbal or non-verbal, and will take all safety measures so that other people who may be in the location at the time of the service/services do not also violate the legal rules. In this sense, the client shows that he was informed about the incidental legal provisions, respectively those concerning the right to life, bodily integrity and health of persons, provided by art. 188 and the following of the Criminal Code.

The client will ensure the representative's access to his means of communication (e.g. mobile phone), for the entire period of the representative's presence in the location. The customer will provide the supplier with appropriate access to the utilities in the location, in order to provide the ordered service/services in good conditions.

We want to permanently improve the services made available through the Magic Oriunde project, so we reserve the right to ask customers to express their opinion on their relationship with us and with Magic Oriunde representatives, to the extent of their availability, through an online or telephone feedback , the client agreeing to the provision of the necessary data.

Art 5. Privacy Policy, copyright

The data that the Client, the Supplier and the Representative become aware of as a result of the use of the platform and the provision of services are confidential for third parties.  

The supplier undertakes to collect and store the client's data strictly for the purpose of intermediation of beauty services, for their improvement and for the purposes of communication Marketing Campaigns. The supplier guarantees the safety of the data provided by the client and the representative and the fact that he will not alienate the client's data and will not use them for any purpose other than those resulting from these conditions.

The customer agrees to use Magic Anywhere services only for legal purposes and undertakes to comply with the applicable laws and regulations in force.  

The customer agrees that he has no right to modify, distribute, transmit, display, publish, reproduce, grant licenses, create derivative products, transfer or sell any kind of information or service obtained through the platform .  

The customer will not present himself with another identity in order to deceive or mislead other people. Violation in any way of this provision may lead to the blocking of the client's access to the Platform and, where applicable, to the notification of the competent authorities.  

The customer will provide all the data necessary for his registration on the Platform.  

It is possible to process some of the customer's data, in the context of the provision of services, based on legal obligations (e.g. for reporting purposes or for anti-money laundering purposes) or the obligations imposed on the platform by the applicable legislation. Personal data will be deleted when they are no longer needed.  

The provider is the sole owner of the copyright on the platform, as well as on the concept of providing Magic Oriunde services. The customer will refrain from any copying of them, from any action or inaction that could create damage to the supplier and could endanger the free exercise of his copyright.  

Art 6. Applicable law and conflict resolution

The law applicable to this contract is the Romanian law in force on the date of its conclusion, through the acceptance of the Terms and Conditions by the Client. These provisions are supplemented with the incident norms, in force. 

The Magic Oriunde service provider does not assume responsibility for: destroyed or damaged objects, the disappearance of personal objects or certain aspects related to the client's state of health and possible situations in which he falls ill. 

In the event of the existence of conflicts related to the present Terms and Conditions, the parties undertake to try to resolve them amicably. In the event that an amicable solution is not possible, the parties agree to resolve the conflicts through the competent courts. 

Art 6. Other Clauses

The organizer reserves the right to modify these Regulations during the existence of the Magic Oriunde service, without prior notification. The modified version will be made known to the clients by posting it on the website www.saloanelemagic/juridic.

The eCommerce Magic Store service beneficiary is responsible for reading and understanding the Terms and Conditions. Continued use of this service implies agreement and acceptance of these terms.

The general terms and conditions set forth below apply to all sales of goods by Magic Smart Grup SRL through the Magic Store project and its partners and may be modified at any time by Magic Smart Grup SRL without prior notice.

Client/Buyer - a natural and/or legal person benefiting from Magic Store eCommerce services, an online platform user.

Magic Store Service Provider/Seller - the holder and administrator of the Saloanele Magic Application and owner of Magic Store.

Delivery Address/Location - The Magic Store concept covers the entire territory of Romania.

My Cart - a section in the Account that allows the buyer/user to add goods or services they wish to purchase at the time of adding or at a later time; in the event that the goods or services are not purchased at the time of adding by placing an order, the Buyer/User will benefit from the service provided by the Seller to track goods and services by receiving commercial communications from it.

Order - an electronic document that serves as a form of communication between the Seller and the Buyer, through which the Buyer conveys their intention to purchase Goods and Services from the site.

Goods and Services - any product or service listed in the shop, including the products and services mentioned in the order, to be provided to the Buyer by the Seller as a result of the concluded contract.

 

Product of the Day - the commercial exposure of a finite number of Goods and/or Services, with limited and predefined stock, for a limited period of time, established by the Seller.

 

Transaction - the collection of an amount resulting from the sale of a good and/or service by Magic Store to the Buyer, using the payment processor services agreed upon by the Seller, regardless of the delivery method.

Specifications - all specifications and/or descriptions of Goods and Services, as specified in their description.


Token - a unique encrypted number associated with the Buyer's payment card after making an online payment, after activating the PaybyClick service, and which can be used by the Buyer to authorize transactions through the PaybyClick service.

Intellectual Property Right - all intangible rights, such as copyright and related rights, database rights, design rights, model rights, patents, registered trademarks, and domain name registrations for any of the above.

Art 3. Accessing the Platform and Using Magic Store Services

Magic Store services can only be used in accordance with the rules in the Terms and Conditions.
By implementing and making available the Saloanele Magic Mobile Application Saloanele Magicthe Provider creates a secure virtual environment in accordance with all legal and data security regulations, in order to ensure the connection between the client and the representative.
By accessing and registering on the Platform, the Client certifies that:they are at least 18 years old, have full legal capacity, and there are no other legal impediments to engaging in legal relationships with the Magic Store provider, servicesrespectively, with the representatives of services.
The purchase of products online by the Client is done as follows: The Client accesses the Saloanele Magic, registers in the account or creates a new account, and accesses the "Shop" button.
The Client selects the desired products, adding them to the cart and selecting the desired quantity.
The Client finalizes the order by providing the delivery address and selecting the desired payment method - cash on delivery or online with a card. By registering an order on the Site, the Buyer agrees to the form of communication (telephone or chat in the application) through which the Seller conducts its business operations.

For justified reasons, the Seller reserves the right to modify the quantity of Goods and/or Services in the Order. If the quantity of Goods and/or Services in the Order is modified, the Buyer will be notified at the phone number provided to the Seller when placing the Order, and the amount will be refunded if it was paid online with a card.

Communication with the Seller can be done through online support (Chat Application) or by phone. The Seller has the freedom to manage the information received without being obliged to justify this.
All fees related to the Goods and/or Services presented on the Site are expressed in Romanian Lei (RON) and include VAT.

In the case of online payments, the Seller cannot be held responsible for any additional costs incurred by the Buyer, including but not limited to currency conversion fees applied by the issuing bank of the card if its currency differs from RON. The Buyer bears sole responsibility for this action.
All information used to describe the Goods and/or Services available on the Site (images) does not constitute a contractual obligation on the part of the Seller; they are used solely for presentation purposes.

 

Art 4. Order

4.1. The Client/Buyer can place Orders in the Saloanele Magic Mobile Application, in the Shop section, by adding the desired Goods and/or Services to the shopping cart and then finalizing the Order by making payment through one of the specified methods. Once added to the shopping cart, a Good and/or Service is available for purchase as long as there is available stock for it. Adding a Good/Service to the shopping cart without finalizing the Order does not constitute a placed order and therefore does not automatically reserve the Good/Service.

4.2. By finalizing the Order, the Buyer consents that all data provided by them, necessary for the purchasing process, are correct, complete, and true at the time of placing the Order.

4.3. By finalizing the Order, the Buyer consents that the Seller may contact them, by any means available/agreed upon by the Seller, in any situation requiring contact with the Buyer.

4.4. The Seller may cancel the Order placed by the Buyer, following a prior notification to the Buyer, without any subsequent obligations of either party towards the other or without either party being able to claim damages from the other, in the following cases:

4.4.1. Non-acceptance by the issuing bank of the Buyer's card transaction in the case of online payment.

4.4.2. Transaction invalidation by the card processor agreed upon by the Saloanele Magic application in the case of online payment.

4.4.3. The data provided by the Client/Buyer on the Site is incomplete and/or incorrect.

4.5. The Buyer has the right to withdraw from the Contract, namely to return a Good or give up a Service, within 14 calendar days, without invoking any reason and without bearing any costs other than the delivery costs. Thus, according to the Government Emergency Ordinance no. 34/2014, the return period for a Good or waiver of a Service expires within 14 days from:

  • • The day the Buyer physically acquires the last Good - in the case where the Buyer places a single order for multiple products that will be delivered separately
  • • The day the Buyer physically acquires the last Good or the last part - in the case of delivering a product consisting of multiple lots or parts

4.6. If the Buyer decides to withdraw from the Contract, they will signal the intention to return the product through the application's chat.

4.7. In case the Order is paid, the Seller will refund the amount within a maximum of 14 (fourteen) days from the date the Buyer informs the Seller of their decision to withdraw from the Contract.

The amount will be refunded as follows:
4.7.1. For Orders paid with a bank card - by refund to the account from which the payment was made or by generating a voucher with the value of the returned product.
4.7.2. For Orders paid cash on delivery or with cash at the salon - by cash refund at the salon, with a written request, by refunding the value of the product into the bank account provided by the customer, or by generating a voucher with the value of the returned product.

4.8. The Seller may postpone the refund until receiving the sold Goods or until receiving proof that they have been dispatched, if they have not offered to retrieve the Goods themselves (the most recent date will be taken).

4.9. If the Good is returned in a condition that no longer allows it to be sold as new (opened packaging, missing accessories, damaged Good), we reserve the right to charge a fee to bring the Good back to its initial state, or to cover the price difference resulting from the resale of the product as resealed, or, at the request of the Buyer, we will re-send the Good, and the delivery costs will be borne by the Buyer.

4.10. If a Good and/or Service ordered by the Buyer cannot be delivered by the Seller, the latter will inform the Buyer about this fact and will refund the value of the Good and/or Service to the Buyer's account, within a maximum of 7 (seven) days from the date the Seller became aware of this fact or from the date the Buyer expressly expressed their intention to terminate the Contract.

Art 5. Order Delivery
The Seller will ensure proper packaging of the Goods and will deliver the Goods and Services only within the territory of Romania.
After an order has been processed, depending on the Buyer's choice, it can be delivered by:
5.1. Courier delivery, GLS - a fee of 15 lei will be charged, regardless of the location.
5.2. Possibility of pickup from a Magic Salon - Free
. If this option is chosen, following a telephone discussion, the Buyer can choose one of the 16 physical locations of the Seller:

The Buyer will receive a phone call from a representative of Magic Magazin, informing them of the date when they can pick up the order from the desired location.
For orders paid online (with a bank card, in installments, by iTransfer, bank transfer), the Buyer must have an identity document for product delivery.

 

Art 6. Payment

6.1. The prices of Goods and Services displayed in the Magic Magazin of the Saloanele Magic Application include VAT according to the current legislation.

6.2. The price, payment method, and payment term are specified in each Order.

6.3. PaybyClick payment is a fast online payment method with a card, which consists of making the payment with a single click by using the Token associated with the card, without the need to enter the card details for each Transaction.

6.4. The card payment details of the User/Buyer will not be accessible to Magic Magazin, and they will not be stored by Magic Magazin or by the payment processor integrated into the Site, only by the Transaction authorization institution or another entity authorized to provide card identification data storage services, about which the User/Buyer will be informed before entering the data.

 

Art 7. Confidentiality

7.1. The Saloanele Magic Application will keep confidential any information of any kind provided by the Users. Disclosure of the information provided will only be possible under the conditions mentioned in this Document.

7.2. No public statement, promotion, press release, or any other form of disclosure to third parties will be made by the Buyer/Client regarding the Order/Contract without the prior written consent of the Seller.

 

Art 8. Other Clauses

The Organizer reserves the right to modify this Regulation during the existence of Magic Oriunde service, without prior notification. The modified version will be made known to the customers by displaying it on the website www.saloanelemagic/juridic.

Art 4. Accessing the Platform and Using Proximity Tips Service
Proximity tips can only be used in accordance with the current rules set out in the Terms and Conditions.
By implementing and making available the Saloanele Magic Mobile Application Saloanele Magicthe Provider creates a secure virtual environment in accordance with all legal and data security regulations, in order to ensure the connection between the client and the representative.
By accessing and registering on the Platform, the Client certifies that:they are at least 18 years old, have full legal capacity, and there are no other legal impediments to engaging in legal relationships with the Magic Store provider, Tips Proximity,respectively, with the representatives of Tips Proximity. The Client agrees to provide their personal data for the purpose specified in these terms.
The campaign addresses only the individuals mentioned in Article 2.
Proximity tips represent a service at a reduced price, in the location closest to the customer's home, from the list of locations in Art 3.
Proximity tips can be purchased through the Magic Salons mobile application, available on Google Play, App Gallery, and App Store, from the Offers section, Proximity Tips. Adding the domicile address is necessary for the application to generate the nearest location to the client's domicile.
The client has the right to purchase only one proximity tip. Once purchased, they will no longer be displayed, and therefore, no additional ones can be acquired.

Each Proximity Tip includes the following details: service, salon name, and the validity period during which the tip is available.

Proximity tips are purchased as follows: the beneficiary must select the "Buy" buttonCumparawithin the desired Tip, fill in their card details, and complete the transaction.

Card details will only be filled in the application for the first time, after which Magic Smart Grup will generate a digital token allowing the client to make purchases in the application without entering card details each time. Through this technology, Magic Smart Grup does not store or process the client's card details entered. In the event of changing the payment method, the client can contact Magic Smart Grup representatives to modify/delete the token created initially during the first purchase.

The company SC Magic Smart Grup SRL SC Magic Smart Grup stores the following personal data of the client: name, surname, phone number, date of birth, and email address. All of this is stored only in the client's personal account, and the Company uses it exclusively with the client's consent and desire to purchase Proximity Tips. This information is not used for any other purposes in any form.
he domicile address is requested by the Company solely for the purpose of transmitting the nearest location and is not stored.

The Company does not directly store any information regarding its clients' cards. 
All payments are processed by NETOPIA, a platform dedicated to payment processing, and for any transaction made by clients, a token is provided to them.

The Proximity Tips have assigned only the location where they are valid. A period of validity is set, and the appointment will be made according to the availability during that period.
Tip details cannot be changed, and their value cannot be returned. Therefore, the people who purchase them and, for whatever reason, do not show up for the appointment, will not receive back the value of the purchased tip.

Article 5: Duration
The period of validity of the PONTURI PROXIMITATE program is unlimited, starting from 26.10.2020.

Article 6. Validity Conditions

To benefit from PROXIMITY TIPS, the beneficiary must simultaneously meet the following conditions:
a) The participant must meet the conditions in Article 2.
b) In the case where the beneficiary is an existing client of the Organizer, they must register in the application using a unique identification code, which can be obtained from the salon or from various online channels: chat within the application / chat on the website / Facebook / Instagram / email, etc.
c) In the case where the beneficiary is not a Magic client, they can register by completing a form with their name, surname, phone number, and email address. An activation key will be sent via email, allowing them to register in the application and purchase Proximity Tips.

Article 8 - Other Clauses

The Organizer reserves the right to modify this Regulation during the existence of Proximity Tips,without prior notification. The modified version will be brought to customers' attention by posting it on the website www.saloanelemagic.ro.

By accessing and registering on the Platform, Saloanele Magic, respectively, the service Magic Gift,, The user agrees to receive calls and text messages from the Magic Smart Grup SRL company on the mobile phone, a necessary step to facilitate the completion of the gift order.

Also, by entering the phone number of the Gift Beneficiary, the User is responsible for the Beneficiary's preliminary agreement to be contacted by phone in order to contact by phone, respectively to offer the Magic Gift experience.
Magic Gift,
 represents a service through which a User can offer a programmed gift to a Beneficiary, through the Saloanele Magic mobile application.

To benefit from the Magic Gift service, the User must access the Saloanele Magic mobile application, the Gift section, and follow the following steps: choose the contact to whom they want to give the gift, from the phone book, select the contact with the respective person, the reason category , the reason, an additional message to be sent, the date on which the contact wants to be contacted by phone, to allocate the budget for the gift and to pay it directly from the application.

In order to use this service, the User will be asked for permission for the application to access the phone book.
The company SC Magic Smart Grup SRL does not directly store any information regarding the contacts in the User's phone book - the only phone number stored will be that of the selected/desired contact - in order to contact him, so that the MAGIC GIFT experience can be sent to him.
The contact, also called the Beneficiary, also called the Person who will receive the gift - will be contacted by phone by the Magic Smart Grup company, on the date mentioned by the User in the application.
The Magic Consultant will request the Beneficiary's agreement to use personal data by phone and on Whatsapp in advance and will request the provision, for confirmation, of the name, phone number and any other type of personal data required to receive the gift. In this sense, the Magic Smart Grup consultant will send the messages from the User by phone and they will be able to determine the gift together, in the amount of the budget paid by the User in the application.

3.1. The beneficiary can choose between:

3.1.1. Beauty services at one of the Organizer's locations.In this case, the value of the allocated budget will be transferred to the Beneficiary's account in loyalty points (1 point = 1 leu), which can be used anytime, starting from the next visit.

In the case that the Beneficiary does not have a loyalty account created, they need to create one.
For this purpose, the following data will be requested: name, surname, phone number, date of birth, and email address.
All this information is stored only in the client's personal account. This information is not used for any other purposes in any form.

3.1.2. Magic Anywhere beauty services.
The Beneficiary can choose beauty services at any address in Bucharest or Ilfov through Magic Anywhere.
The services will be determined alongside a Magic consultant, and if the requested Magic Anywhere services are more expensive, the Beneficiary will pay the price difference online. If the desired services cost less than the total budget allocated, the Beneficiary has 2 options: either the remaining amount will be returned to them in loyalty points to their customer account (in this case, they can use the points whenever they want), or they can order products from the Magic Store.

3.1.3. Products from the Magic Store

The Beneficiary can choose products from the Magic Store.
he Magic consultant will provide support in choosing the most suitable gift and will place the order for the Beneficiary.
he Beneficiary can choose the free transport option to one of the locations presented in Article 3.1.1. or the delivery option to the desired address, with a transport cost of 10 lei. This transport cost will be deducted from the gift budget in the case of choosing this option.

If the order amount is less than the gift budget, the price difference between the budget and the order will be allocated to the Beneficiary's Loyalty Account in the form of loyalty points.
If the order amount exceeds the gift value, the Beneficiary will pay the difference either in cash upon delivery if they choose the courier delivery option or they will be provided with a payment link, and they will pay with a card if they choose to pick up the order from one of the Organizer's locations.

Payment for the gift by the User can only be made with a card within the application.
Card details will only be filled in the application for the first time, after which Magic Smart Grup will generate a digital token allowing the client to make purchases in the application without entering card details each time. Through this technology, Magic Smart Grup does not store or process the client's card details entered. Regulation for "Magic Raffles"

Article 1. Organizer

The organizer is the company SC Magic Smart Grup SRL,with headquarters in Bucharest, 27 Serg. Nutu Ion Street, Sector 5, Bucharest, registered in the Trade Register under no. J40/9408/2014, VAT number RO33472999.

2.1. Participation Rights

Any persons who installs the mobile application Saloanele Magic purchases beauty services from the Organizer's locations, and completes the Challenges through the "Magic Salons" mobile application to accumulate as many chances as possible can participate in the "Magic Raffles" contest.

2.1. RIGHT TO PARTICIPATE

If the winner of one of the prizes is a minor (under 18 years old), they will be entitled to receive the prize only with the written consent of their parents or legal guardian. If the winner of one of the prizes is legally incapacitated (due to a situation other than being under 18 years old), they will be entitled to receive the prizes only with the written consent of their legal guardian. Employees of the organizer and its partners involved in the organization and conduct of the raffles, as well as first and second-degree relatives of the individuals identified above, are not eligible to participate in this campaign.

Art 3. Locations

The contest is valid at the Organizer's locations:

The contest takes place using the "Magic Salons" mobile application on the territory of Romania.

Article 4. CAMPAIGN

The campaign is exclusively addressed to persons mentioned in Article 2. The purpose of the campaign is to promote the products and services of the Organizer.

During the campaign period, participants can register by following these steps:

  • Firstly, the Participant needs to install the "Magic Salons" mobile application, available on Google Play, App Store, or AppGallery, and authenticate with the unique identification code. The authentication code is obtained through the Mobile Application. When opening the application for the first time, authentication will appear as a mandatory step.
    Participants need to enter their phone number in the designated box. If found in the database, they will receive a message with the authentication code. If they don't have an account, they can create one by filling in the required fields: name, surname, date of birth, and email address.
  • The Participant can increase their chances of winning by purchasing beauty services from Magic Salon.
  • During the campaign, the Participant can earn more chances of winning through various channels, including:
    • Purchasing beauty services at the salon or through the Magic Anywhere service.
    • Purchasing products from magicmagazin.ro.

Any of the above actions guarantee participation in the "Magic Raffles."

The number of accumulated chances is directly proportional to the number of entries in the raffle (e.g., accumulating 500 chances as a result of the Participant's actions will result in 500 more chances to win).

Winning chances through the purchase of services and products: For every lei spent on salon services or beauty services through Magic Anywhere and product orders from the application's Shop section, the Participant will receive 1 chance. For example, if they have a receipt of 100 lei, they will earn 100 chances.
The number of chances can be tracked at any time within the "Magic Salons" mobile application in the My Account section.

Article 5. REGISTRATION AND DRAWING DATA

Registration for the raffles will be as follows:

-The client enters the Play section of the "Magic Salons" mobile application, where existing raffles and their expiration dates will be displayed.

- The client will choose which raffles to participate in by simply pressing a button, and there is no limit to the number of raffles they can join.

- The winners will be drawn using a randomization application.

Article 6. RAFFLES MECHANISM

Once the participant clicks "Register," a pop-up will appear with the details of the ongoing raffle and a "Participate" button. At that moment, the participant is registered with their current number of chances in the system, resulting from salon visits and/or purchased products from the Magic Store.

Article 7. ACCEPTANCE OF THE PRIZE

The winner will be contacted by the Organizer within a maximum of 3 days to provide details regarding claiming the prize.
By accepting the prize, the winner agrees to allow their name and image to be made public and used by the Organizer for advertising purposes. The winner cannot make any financial claims against the Organizer for the production and dissemination of such materials.
If the Organizer finds that the person designated as the winner has not fulfilled or has not complied with any of the conditions stipulated in this Official Regulation, the Organizer reserves the right to suspend or withdraw the rights and benefits of the winner at any time, without any compensation or payment to the respective winner.

The Organizer will not provide any compensation in cash or other benefits to potential winners who do not comply fully with the requirements of the Official Regulation of the Contest.

Article 8. PROCESSING AND PROTECTION OF PERSONAL DATA

By this Official Regulation, the Organizer and the advertising agencies involved in the organization of the Campaign undertake to comply with the provisions of:

  • Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation, GDPR);
  • Law 677/2011 on the processing of personal data;
  • Government Emergency Ordinance no. 99/2000 on the marketing of products and services, as subsequently amended by Law no. 650/2002;
  • Law 227/2015 on the Fiscal Code, with subsequent amendments and completions;
  • Romanian Civil Code, as well as all applicable laws related to the conduct of this campaign.

6.2 By enrolling in the Campaign, the Participants agree to all the provisions of the Regulation and undertake to respect them as such, fully understanding all their effects. As a result, if they win, the participants accept that, for the Organizer to fulfill the obligations imposed by art. 42, para. (2) from Government Ordinance no. 99/2000, their names and the prize won will be made public under the conditions mentioned above in this Regulation.
6.3. Registration in the Campaign, its development and effects involve the collection and processing of personal data. The personal data collected are:
(i) for Participants: phone number
(ii) for winners: name, surname, signature, no. phone number, e-mail address, postal address, bank account, CNP from CI, photo.
6.4. The personal data operator (hereinafter referred to as the "Operator") is the Campaign Organizer, Magic Smart Grup S.R.L.
6.5. The purpose of collecting and processing personal data mentioned in art. 8.3 and 11.2 above represent: the registration in the Campaign, the running of the Campaign, the validation of the winner, the awarding of the prize, the awarding of the prize, the benefit of the won prize, the resolution of any complaints related to the running of the Campaign, formulated according to the provisions of these Regulations, as well as the fulfillment by the Organizer and Powers of attorney for the obligations stipulated by the legislation in force.
6.6. The legal basis for the collection and processing of personal data mentioned in art. 8.3 and 11.2 above constitutes the promotional campaign addressed by the Organizer to the general public, accepted by the participants through voluntary registration, and the legal basis is represented by art. 6 para. (1), letters a) and 11.7. Below are briefly described the rights that the GDPR confers on the Participants and the winner, as data subjects (the persons concerned):
A. Right of access to data
(1) Any Data Subject has the right to obtain from the Operator confirmation of the fact that the data concerning him are or are not being processed by him. Obtaining the confirmation is based on a written, dated and signed request, addressed to the Operator, sent to his address mentioned in Section 1 of the Regulation.
(2) The Data Subject has access to the following information:
(a) the purposes of the processing;
b) the categories of personal data concerned;
(c) recipients or categories of recipients to whom the personal data have been or will be disclosed, especially recipients from third countries or international organizations;
(d) where possible, the period for which the personal data is expected to be stored or, if this is not possible, the criteria used to establish this period;
(h) the existence of an automated decision-making process including the creation of profiles, mentioned in Article 22 paragraphs (1) and (4) of the GDPR, as well as, at least in the respective cases, pertinent information regarding the logic used and regarding the importance and the expected consequences of such processing for the data subject.
(3) The Controller provides a copy of the personal data undergoing processing free of charge. For any further copies requested by the data subject, the Controller may charge a reasonable fee based on administrative costs. If the data subject submits the request electronically and unless otherwise requested by the data subject, the information is provided in an electronic format commonly used.
B. The right to rectification: refers to the correction, without undue delay, by the Operator of inaccurate personal data concerning the Data Subject. The Data Subjects have the right to complete or correct incomplete personal data, including by means of an additional declaration.
C. The right to data deletion (“the right to be forgotten”): Data Subjects have the right to request the Operator to delete personal data, without undue delay, if one of the following reasons applies:
(i) personal data are no longer necessary to fulfill the purposes for which they were collected or processed;
(ii) The Data Subject withdraws his consent and there is no other legal basis for the processing;
(iii) The Data Subject opposes the processing and there are no legitimate reasons to prevail;
(iv) Personal data has been processed illegally;
(v) Personal data must be deleted to comply with a legal obligation;
D. The right to restrict processing can be exercised in the following cases:
(i) The Data Subject contests the accuracy of the data, for a period that allows the Operator to verify the correctness of the data;
(ii) The processing is illegal, and the Data Subject opposes the deletion of personal data, requesting the restriction instead;
(iii) The operator no longer needs the personal data for the purpose of processing, but the person requests them for establishing, exercising or defending a right in court;
(iv) The Data Subject objected to the processing for the period of time in which it is checked whether the legitimate rights of the Operator prevail over those of the respective person.
In the above cases, the respective data will be marked and can be processed by the Operator and/or his Powers of Attorney only for certain purposes.
F. The right to data portability: If during the course of the campaign and its effects the Organizer changes, the Data Subject has the right to receive the personal data concerning him and which he transmitted to the Organizer initially in a way structured, currently used and which can be read automatically and has the right to request the direct transmission of this data to the new organizer, without obstacles from the initial Organizer.
G. The automated individual decision-making process, including the creation of profiles: the Data Subject has the right not to be the subject of a decision based exclusively on automatic processing, including the creation of profiles, which produces legal effects that concern or affect him in a similar way in a significant measure. The previously mentioned do not apply if the automatic processing is necessary for the conclusion or execution of a contract with the Organizer, if the Organizer has an authorization in this regard and if the person concerned has given his explicit consent.
H. The right to object: The right to object, on grounds related to the Data Subject's particular situation at any time, to the processing of his/her personal data. In the case of exercising the objection to the processing, the personal data of the Data Subject who formulates the objection will no longer be processed. Exercising this right is free of charge. This right can be invalidated in particular if the processing of personal data is necessary for the formalities related to the fulfillment of legal or contractual obligations by the Operator and/or its Authorized Representative.
I. The right to file a complaint: The right to file a complaint with the National Authority for the Supervision of the Processing of Personal Data in relation to aspects related to the processing of personal data by the Operator and/or its Authorized Representative.
6.7. All the rights listed above are exercised by sending a written, dated and signed request to the Organizer's headquarters, mentioned in the preamble, or to the e-mail address marketing@saloanelemagic.ro.

Art. 9. Duration

Registration period: January 1 - December 31, 2023 (including).

Art. 10 – OTHER CLAUSES

The Organizer reserves the right to modify this Regulation during the existence of the "Tombolele Magic" program, without prior notification. The modified version will be brought to the attention of the customers by displaying it on the website www.saloanelemagic.ro.
